DISSOLUTION OF MARRIAGES (DIVORCE)

  

  

  • Canon law constitutes an integral component of Lebanon's confessional personal status legal framework. Under the Law of 2 April 1951, the jurisdiction of the religious authorities of all recognized Christian denominations and the Jewish Community is defined and regulated. The Law further governs the enforcement of their judicial decisions and establishes the legal framework for resolving jurisdictional disputes arising among the various religious authorities or between those authorities and the Lebanese civil courts.


  • The Law applies to the following recognized religious communities:

· Maronite Church

· Greek Orthodox Church

· Melkite Greek Catholic Church

· Armenian Orthodox Church

· Armenian Catholic Church

· Syriac Orthodox Church

· Syriac Catholic Church

· Assyrian Church of the East (Nestorian)

· Chaldean Catholic Church

· Latin Church

· Evangelical Community

· Coptic Orthodox Church

· Jewish Community

Each of these religious communities maintains its own personal status legislation, judicial procedures, and independent ecclesiastical courts, which exercise exclusive jurisdiction over matters entrusted to them under Lebanese law.


  • Jurisdiction of the Ecclesiastical Courts

Ecclesiastical courts adjudicate personal status disputes in accordance with the canonical legislation governing each respective denomination. Their jurisdiction is exercised within the theological and ecclesiastical understanding of marriage, with particular emphasis on the sacramental nature, sanctity, permanence, and essential characteristics of the marital bond.

While each denomination applies its own substantive canon law and procedural rules, the judicial process governing matrimonial proceedings generally follows similar procedural principles.


  • Matrimonial Proceedings

Proceedings concerning the dissolution of the marital bond ordinarily involve several procedural stages, including:

· An initial reconciliation hearing aimed at facilitating an amicable resolution between the spouses.

· Should reconciliation prove unsuccessful, the matter proceeds before the competent ecclesiastical court.

· The submission and examination of documentary and testimonial evidence.

· Judicial investigation of the relevant facts.

· Examination of the parties and the hearing of witnesses.

· Appointment of psychological, psychiatric, or social experts whenever required by the circumstances of the case.

· Any additional procedural or evidentiary measures deemed necessary by the Court in order to establish the relevant facts.

The purpose of these proceedings is to enable the Court to determine whether the legal requirements have been satisfied for the issuance of an appropriate canonical judgment, including:

· a declaration of nullity of marriage;

· dissolution of the marriage in cases recognized by the applicable canon law; or

· divorce, where permitted under the personal status laws governing the relevant religious denomination.


  • Confidentiality of Proceedings

One of the fundamental characteristics of ecclesiastical proceedings is their strict confidentiality. Court files, testimony, expert reports, and procedural documents are treated as confidential in order to preserve the privacy, dignity, and personal interests of the spouses and any other individuals involved in the proceedings.

This principle of confidentiality reflects the sensitive nature of family disputes and serves to ensure that matrimonial litigation is conducted with the highest degree of discretion and respect for the parties' personal and spiritual rights.

الحق الكنسي هو جزء من نظام الأحوال الشخصية الطائفي في لبنان. حيث جاء القانون 2 نيسان 1951 ليحدد صلاحيات المراجع المذهبية لجميع الطوائف المسيحية والطائفة الإسرائيلية وتنفيذ أحكامها وحل الخلافات التي تنشأ فيما بينها أو بينها وبين سائر المراجع المذهبية أو المحاكم المدنية اللبنانية

يشمل هذا القانون الطوائف التالية

الطائفة المارونية – طائفة الروم الارثوذكس – طائفة الروم الكاثوليك الملكية – طائفة الأرمن الارثوذكس – طائفة الأرمن الكاثوليك – طائفة السريان الأرثوذكس – طائفة السريان الكاثوليك – الطائفة الشرقية النسطورية – الطائفة الكلدانية – الطائفة اللاتينية – الطائفة الانجيلية – الكنيسة القبطية الارثوذكسية – الطائفة الإسرائيلية

لكل طائفة من الطوائف المذكورة نظامها القانوني ومحاكمها الخاصة

ينظر في الدعاوى الروحية لدى مختلف الطوائف المذكورة إلى قدسية الزواج وخصائصه ومميزاته من ناحية المفهوم الروحي الكنسي 

حيث لكل طائفة قوانينها وأحكامها وأصولها القانونية والقضائية

إلا أن ما يجمعها هي أساسيات شكليات مسار دعاوى حل الرباط الزواجي؛ حيث تترجم الإجراءات بالشكل التالي

- يصار أولاً إلى إجراء جلسة مصالحة للزوجين وفي حال فشلها، تسلك الدعوى مسارها القضائي 

- ان لناحية جمع البينات 

- والتحقيق 

- والاستجوابات والشهود 

- والخبرة النفسية أو الاجتماعية 

- وغيرها من الأعمال والإجراءات حيث تختلف من دعوى إلى أخرى

كل ذلك بهدف الوصول إلى الحقيقة وإعلان بطلان، فسخ زواج المتداعيين أو طلاقهما

نذكر أخيراً إلى أن أهم ما تتميز به الدعاوى الروحية هي السرية وذلك صوناً لحماية خصوصية كل من الزوجين
