Trademark infringement & unfair competition litigation

 Our client a renowned Lebanese International Haute couture Designer came to us for Legal counsel concerning his commercial name and trandemark, he has been using his own civil name as a trademark for his business for the past 40 years, a new designer opened his atelier a block away, and was using a similar trademark, customers were confused about the identity, and the confusion spread on social media especially on facebook and instagram, litigation became a necessity when a Bollywood actress hashtaged the wrong designer, and by giving credit to the wrong designer because of the confusion between similar commercial names, it was necessary for the firm and the client to resolve the dispute. A law suit was filed, Tohme Legal & our client, won the case, the court ordered the other designer to change his commercial name/ and trademark, with a 300,000LBP fine for every day of non compliance with the court order. The other designer was not complying so we had to file another lawsuit to enforce the court order, we also won that case and the other designer was fined for non compliance. verdict number 11/2016 and 86/2016 pronounced by the first instance court of mount Lebanon - Jdeideh - commercial case.
